Attorney David Bundrick Wins Case For Co-Defendants Charged with Possession of Drugs and Paraphernalia

Clients Were Charged During Routine Traffic Stop, Faced Up to Nine Years Collectively Paducah, Kentucky: A routine traffic stop led to the arrest of two clients of Attorney David Bundrick. After they were stopped for a seatbelt violation and asked to step out of the vehicle, a police officer found approximately a gram of methamphetamine in one defendant’s pockets. Cocaine, marijuana, and drug paraphernalia were also discovered after police officers searched the vehicle. The co-defendants were both charged with possession of methamphetamine, which carries up to 3 years in prison. One defendant had an additional charge of possession of cocaine and possession of drug paraphernalia and faced up to six years in prison.. Attorney David Bundrick with Edwards and Kautz filed a Motion to Suppress Evidence because the police officer failed to positively identify a weapon or contraband before reaching into the defendant’s pocket during the frisk. During a frisk, a police officer can seize weapons or items that are identifiable as contraband. However, as the police officer could not positively know through a frisk that there was contraband in the defendant’s pocket, the search was illegal. The judge granted the Motion to Suppress, ruling the evidence inadmissible in court, and the prosecution then filed a Motion to Dismiss the case against both defendants. Edwards and Kautz congratulates David Bundrick on another successful case. Bundrick joined the firm in 2010 and is a graduate of the University of Kentucky School of Law. Before joining the firm, he was a public defender for four years, trying cases from minor traffic offenses to murder.
